Here is the good news for all land owners of India. Property owners who enter into agreements with builders and real estate dealers now can approach the consumer forum for breach of conditions. According to the recent verdict of the Supreme Court , the builders are deemed to be "service provider" under the Consumer Protection Act. But, there is no such remedy under the Act for the builder against the land owner, as the builder has to move only a civil court for appropriate remedy. The apex court has said said that right of property is a constitutional and a human right which a person cannot be deprived of except in cases where the statute calls for the same. Though right of property no longer remains a fundamental right,it is still a Constitutional Right and a human right. In the absence of any provision either expressly or by necessary implication, depriving a person from his property, the court shall not construe a provision leaning in favour of such deprivation. The growing demand for property in the Metros and their suburbs has created massive land scams. In this regard, the Supreme Court's judgements will definitely help the property owners in preserving their rights. It will also decrease the number of less than fair property deals.
